2. INFORMATION ABOUT THE PRODUCTS AND THEIR AVAILABILITY

2.1. Information about the Products, together with the Product codes and their prices, is available on the Site.

2.2. The Products available on the Site represent a selection of the items normally available in stores;

Super Sconti Beauty does not, however, guarantee to the Customer that the Products available on the Site are also available in the stores. The graphical representation of the Products displayed on the Site may be different from reality; therefore, the Customer must rely solely on the description of the Product and its characteristics shown on the Site, In addition, we inform the kind customers that by clicking on the button '' confirm the order'' present when checking out, the customer accepts all the conditions imposed by the company and listed here.. we inform you that for any returns or replacements the shipment to the sender of the products is the responsibility of the customer and under his responsibility.

Pursuant to Legislative Decree 185/99 and ss.mm.ii. you have the right to withdraw from the contract without penalty and without specifying the reason within 14 working days from the day you receive the products. To exercise the right of withdrawal you must give us notice of your decision by e-mail, and then send the products back to us undamaged and in their original packaging. do not send the products with payment and delivery method cash on delivery, as they will not be accepted. Excluded from the right of withdrawal are perishable or custom-packaged products, opened or partially used products. In case of logistical errors ( ex .wrong product) or factory errors ( ex. defective product) we will proceed with the withdrawal of the product and send back any replacement.
Once the pickup of the product to be replaced has been arranged, the customer will not be able to cancel the appointment, and if he/she should not be present when the courier arrives, the total shipping costs will be borne by him/her.

2.3. Super Sconti Beauty reserves the right to limit, at any time, the quantity and/or type of Products that may be purchased on the Site. The style, patterns and colors of the Products described on the Site may be changed without notice. During the purchase process, if it is not possible to process the order due to the unavailability of the ordered Product, the Customer will be notified by an automatic message. Super Sconti Beauty can under no circumstances be held liable to the Customer due to the unavailability of a Product.

2.4. The Customer may include in the order proposal a maximum of ten pieces per single Product.

2.5. Super Sconti Beauty is under no circumstances responsible for any errors resulting from the failure of the Customer's connection to the Site.

3. PRICE

3.1. The price of the Products indicated on the Site is expressed in Euro and is inclusive of all applicable taxes or duties. To the price of the Products must be added the delivery costs, indicated separately in the order form.

3.2. Super Sconti Beauty constantly verifies the accuracy of the prices indicated on the Site; however, it is not possible to guarantee the absence of errors. In the event that an error is found in the indication of the price of a Product, Super Sconti Beauty will reject the order and offer the Customer the opportunity to purchase the Product at the correct price.

4. CONCLUSION OF THE CONTRACT

4.1. The Site lists the essential features and price of each Product. The information on the Site does not constitute an offer by Super Sconti Beauty.

4.2. Before sending an order proposal through the Site, the Customer is required to carefully read all the instructions provided during the purchase procedure (including with regard to delivery costs, the conditions for exercising the right of withdrawal and the Privacy Policy) as well as these General Conditions.

4.3. The transmission of the order proposal constitutes a purchase proposal relating to the selected Product, governed by these General Conditions and binding on the Customer (without prejudice to the right of withdrawal provided for in Article 10 below). The transmission of the order proposal by the Customer entails the latter's obligation to pay the price of the Product, or Products, ordered.

4.4. Before submitting the order proposal, the Customer has the opportunity to make any corrections/changes to the data entered by following the appropriate procedure indicated on the Site (by way of example but not limited to, the Customer has the right to change the quantity of the Products he/she intends to purchase by adding or removing one or more Products from the "Shopping Cart").

4.5. Notwithstanding the use of personal data described in the Privacy Policy, the form with the order proposal and the Customer's data related to the order proposal may be retained by Super Sconti Beauty for the period of time required by applicable law.

4.6. The contract between Super Sconti Beauty the Customer is concluded when the Customer receives confirmation from Super Sconti Beauty of acceptance of the order proposal submitted through the procedure provided on the Site. Super Sconti Beauty 's acceptance (or rejection) of the order proposal will be transmitted to the Customer to the e-mail address indicated by the Customer in the order proposal ("Order Confirmation").

4.7. Super Sconti Beauty onti Flash may reject an order proposal (in which case no amount shall be owed by Customer to Super Sconti Beauty, except, if applicable, for the amounts set forth in Article 6 below) in the following cases:

(I) in case of non-availability of the Products (subject to Articles 3.3 and 5. 9); or(II) in the event that the payment made by the Customer is not successful (by way of example, in the event of failure to charge the purchase price to the Customer's credit card or, if the payment is made by bank transfer, in the event of failure to confirm receipt of the bank transfer within 10 (ten) business days from the date of the order proposal); or(III) in the event that there is a report, or suspicion, of fraudulent or illegal activities, including suspicion that purchases are made for commercial purposes;(IV) in case of failure by the Customer to fulfill its obligations arising from a previous contract concluded with Super Sconti Beauty

4.8. In case of non-availability of one or more ordered Products the Customer will be notified by e-mail. In such an eventuality the order proposal is cancelled, or accepted limited to the available Products. In case of partial acceptance, the Customer is obliged to pay only the price related to the available Products (if payment is made by credit card, the Customer will be charged only the amount corresponding to the available Products).

4.9. In accordance with the provisions of Article 51, paragraph 7, of the Consumer Code, as defined below, the Order Confirmation will contain a summary of the essential characteristics of the Products purchased, a detailed indication of the price and method of payment, information on delivery costs, an indication of an address to which complaints can be made, and information on after-sales services and existing commercial guarantees. The e-mail communication sent by Super Sconti Beauty confirming that the Products have been shipped, in accordance with the provisions of Article 8.1 below ("Confirmation of Shipment").

4.10. The risk of loss of or damage to the Products shall transfer to Customer at the time Customer (or a third party designated by Customer and other than the carrier) physically takes possession of the Product.

5. METHOD OF PAYMENT

5.1. The Customer may make payment of the consideration for the Products contained in the order proposal and shipping costs by cash on delivery.

5.2. Super Sconti Beauty accepts payments made by the following credit cards:

Visa; MasterCard; American Express; Maestro; Paypal

5.3. Transactions will be charged to the Customer's credit card only after:(I) the credit card information has been verified;(II) authorization to charge has been received from the company issuing the credit card used by the Customer.

5.4. In the event that, for whatever reason, within a period of 10 (ten) business days from the date of the order it is not possible to charge the credit card with the amounts due by the Customer (or, in the case of cash on delivery, the funds corresponding to such amounts are not available on the bank account of Super Sconti Beauty, it will not be possible to execute the contract and the order shall be deemed cancelled.

6. TRANSPORTATION AND DELIVERY

6.1. The Products will be delivered to the address indicated by the Customer in the order proposal. At the time of delivery, the signature of the Customer (or his delegate ) is required. No deliveries will be made to post office boxes. Orders will not be delivered to the following geographical locations: Vatican City, Livigno and Republic of San Marino.

6.2. The Invoice must be requested before the purchase is concluded. No Invoices may be requested after the order is closed.

6.3. Delivery Charges:

I) The cost of express shipping with tracking number included is $9.99 including VAT. 

II) In some cases (end-of-stock offers), periods of the year, Super Sconti Beauty may offer free shipping to its customers, at its discretion. However, if the customer wants to use the right of withdrawal, the total shipping costs will be borne by the customer, so it will be deducted from the refund amount.

6.4. Products purchased will be delivered by express courier selected by Super Sconti Beauty (hereinafter "Courier") on business days (excluding, therefore, Saturdays, Sundays and local or national holidays) from 9:00 am to 6:00 pm. Deliveries will be made within 3-6 day (unless force majeure events or unforeseeable circumstances occur) excluding inconvenient areas.

In case of non-delivery, the courier leaves a notice of passage on the intercom/mailbox, notifying the recipient of the passage. A second pass is automatically scheduled the next day. If the recipient is still absent, the shipment will be held at the courier's local branch. The recipient has 3 working days to pick up the package at the courier branch. If no pickup is made within that time, the package is automatically returned to Super Sconti Beauty

6.5. The Customer (or its delegate) is required to check, upon delivery of the Products by the Courier:(I) that the number of packages being delivered corresponds to the number indicated on the delivery note; and(II) that the packaging and its seals are intact, undamaged, not wet or altered in any way. Any damage to the packaging and/or Product or mismatch in the number of packages or markings must be immediately reported in writing to Super Sconti Beauty customer service. Once the Courier's document has been signed with no exceptions raised by the Customer, the Customer will not be able to make any objection regarding the external characteristics of the delivered package.

6.6 After the Product has been shipped, the order can no longer be cancelled or modified.

7. CONFIRMATION OF SHIPMENT AND DELIVERY

7.1. The Customer will receive an e-mail/sms of Confirmation of Shipment following the shipment of the Products.

8. PACKAGING OR PACKING

8.1. Products purchased on the Site are delivered using the normal packaging used by Super Sconti Beauty.

9. RETURN FOR REFUND

9.1. Pursuant to Article 52 of the Consumer Code, as defined below, the Customer has the right to withdraw from the contract within 14 (fourteen) days from the date on which the Customer (or its authorized representative for the receipt of the Product) materially takes possession of the Product.

9.2. To exercise the right of withdrawal, the Customer must request the return procedure by email.

9.3 Within 14 (fourteen) days from the notice of withdrawal (transmitted in accordance with Article 10.2 above) the Customer must return to Super Sconti Beauty the Product purchased, the address to which to send the product will be indicated in the return form downloadable in the previous aritcle. The costs of returning the Product to Super Sconti Beauty shall be borne by the Customer. The Customer is solely responsible for any decrease in the value of the Product resulting from handling the Product other than what is necessary to ascertain its nature, characteristics and operation: therefore, the Customer is required not to remove any labels applied to the Product. The Product must be returned intact without tampering or manipulation.

In the event that the seller ascertains that the returned goods are damaged or that the quantity returned does not correspond to the order, Super Sconti Beauty has the right to refuse to withdraw from the contract and the Customer is also obliged to pay for any damage caused.

9.4. The return for reimbursement has a handling and shipping fee of $9.99 that Super Sconti Beauty will subtract from the amount it must reimburse the Customer , without undue delay and in any event no later than 30 days from the date Super Sconti Beauty was informed of the Customer's decision to withdraw from the contract in accordance with this Article 10.

Such refund will be made by Super Sconti Beauty exclusively by bank transfer. Therefore, the Customer is required to provide his/her bank account number and the account holder, if any. If the purchase was made using a discount code, the amount of the discount will not be refunded. The refund will be related only to the amount actually spent.

9.5. Super Sconti Beauty will suspend the refund until receipt of the returned Product. Upon receipt of the returned Product, Super Sconti Beauty will ascertain the condition of the product itself, and if the goods are intact, undamaged and/or tampered with, a refund will be made to the Customer. The refund will be made within 30 days of receipt of the returned goods at our warehouse.

9.6. The return of Products must be made in all cases in accordance with the procedure set forth in this Article.

10. CUSTOMIZED PRODUCTS

10.1. In accordance with the provisions of Article 59, paragraph 1, letter c), of the Consumer Code, as defined below, the right of withdrawal does not apply to orders for personalized Products such as, by way of example and not limited to, Products on which the Customer's initials are engraved.

11. REPLACEMENT OF PRODUCTS

11.1. Without prejudice to the Customer's rights provided for in Articles 10 and 13 of these General Conditions, Super Sconti does not, in any case, grant the Customer the possibility of replacing Products purchased on the Site with other products.

12.3. DEFECTIVE PRODUCTS

12.1. Should a Product sold by Super Sconti Beauty Flash have a manufacturing defect and in any case for any alleged conformity defect related to Products sold by Super Sconti Beauty, the Customer is required to immediately contact online support.

12.2. The sale of the Products is subject to the legal guarantees provided for in articles 129, 130 and 132 of the Consumer Code, as defined below. Pursuant to these regulatory provisions, the Customer has the right to obtain the restoration of the conformity of the goods by repair or replacement (the Customer may choose whether to obtain the repair or replacement of the Product under the conditions provided by law), at no cost to him or her, or, if one of these remedies is unsuccessful (in accordance with the provisions of Article 130, paragraph 7, of the Consumer Code), he or she may obtain an appropriate reduction in the price of the Products or termination of the contract.

The Customer forfeits these rights if he does not report to Super Sconti Beauty the lack of conformity within the term of 2 (two) months from the date on which he discovered such lack of conformity. The action aimed at asserting a lack of conformity that has not been maliciously concealed by Super Sconti Beauty shall be prescribed, in any case, within 24 (twenty-four) months from the delivery of the Product.

12.3. In the event that the Customer requests, within the terms set forth in this Article 13, the repair or replacement of the Product due to a lack of conformity of the Product, the delivery costs related to the return to Super Sconti Beauty of the Product to be repaired or replaced, as well as all costs related to the delivery to the Customer of the repaired or replaced Product, shall be borne by Super Sconti Beauty

13. WARRANTY OF AUTHENTICITY AND INTELLECTUAL PROPERTY RIGHTS

13.1. The "Super Sconti Beauty" trademark, as well as all figurative and non-figurative trademarks and service marks, found on the Products, their accessories and/or packaging, form marks, whether registered or not, as well as all illustrations, images and logos protected by copyright, and, more generally, all intellectual property rights relating to the Products are and remain the exclusive property of the company.

14. APPLICABLE LAW AND COMPETENT COURT

14.1. These General Conditions and, consequently, the contracts concluded with Customers, are governed by Italian law and must be interpreted according to it (including Legislative Decree no. 206 of 6 September 2005, "Consumer Code" and, in particular, "Chapter I, Title III of Part III" as well as Legislative Decree no. 70 of 9 April 2003, "E-commerce Decree").

14.2 Any dispute arising from the interpretation, validity and/or execution of these General Conditions shall be devolved to the mandatory jurisdiction of the court of the place of residence or domicile of the Customer.
